The government has finally decided that transaction credit can be claimed by individual firms, after getting criticised by two high courts over the GST working portal, even though the earlier deadline given by the government was December 27th, said the officials.
Other than this, Bombay HC also advised the income tax department to create a grievance redressal system for all the queries of taxpayers. Aside from this process, the grievance will also make sure that the individual cases do not land up in the court.
Even the Allahabad HC also mentioned the Centre to either process the petitioner’s application manually or open the GSTN portal for filling the TRAN-1 form, that is used by taxpayers to claim the transaction credit for tax paid on pre-GST-stock.
The officials also said, “we will allow the petitioners access to the GSTN system so that they can claim transaction credit. If they are similar cases with the genuine grievance, they will also be allowed to file the claim but TRAN-1 form will not be opened for all taxpayers”.
The petitioners have claimed that on the last date, even after making various efforts, they could not fill the application (TRAN-1), because the system did not respond on time and that’s why petitioners have suffered the loss of credit that is entitled to by passage by time.
