The government wants some assessees to pay the taxes even before they have some income and ascertain the TDS (Tax Deducted at Source) on it to pay. Such assessee includes those taxpayers who have to pay self-assessment tax amounting more than Rs. 1 lakh for the financial year 2019-20 and if any assessee fails to comply to do so, a penalty of 1% per month will be charged as per section 234A of the Income-tax Act.
The last date to file returns and issue the TDS certificates for banks and other deductors like employers is 31st July 2020 and 15th August 2020, respectively. Because of the coronavirus outbreak, these deadlines were previously set on 31st May 2020 and 15th June 2020 respectively and then shifted. The last date to file the income tax returns for the financial year 2019-20 is 30th November 2020 but the last date to file self-assessment tax for the assessees with a tax liability of more than Rs. 1 lakhs is 31st July 2020, creating some problems for the assessees.
“It seems that this aspect has been missed out by the government as a result of which the present anomaly has arisen. Till the time the government does not amend the notification, the taxpayers will have to estimate their liability and pay tax if they want to avoid payment of interest u/s 234A”, says Sachin Vasudeva, a Delhi-based practicing chartered accountant.
