CAs Can't Mention Fees or Free of Charge in Ads

The Institute of Chartered Accountants of India (ICAI) has prohibited the Chartered Accountants to quote any kind of fee details or ‘Free of Charge’ in any kind of advertisement of the services published by them. Read More of India (ICAI) had issued an Advisory on Mentioning the Fees in Advertisements published by the members of the institute.

The advisory was issued by the department because of the concerns raised by some other members of the institute asking whether it is permissible to quote the fees or free of charge or that the community officials will be charged less or any other kind of other fee-related statements or phrases in the advertisements published by the member CAs for the promotion of their services.

According to Clauses (6) and (7) of Part-I of First Schedule to The Chartered Accountants Act, 1949, it was initially prohibited for the CAs to advertise their services but according to Clause 7, the advertisements are allowed to be published vide “write-up” and according to the Guidelines issued by the institute. ICAI said in its advisory that quoting any kind of fees or free services in the advertisements is prohibited under the Advertisement Guidelines. The website guidelines of the institute, which governs the web advertisement rules and procedures of the websites of the practicing CAs or CA firms, has also stated that providing the names of clients and fees is not allowed under S.no. 6(ix) of the Website Guidelines.

“In view of the above provisions, it is clear that the mandate of posting any particular(s) on Firm’s own website or advertisement through write -up cannot exceed the authority granted respectively vide the Website Guidelines and Advertisement Guidelines of the Institute under any circumstances”, the ICAI also said. The institute has cleared that any quantum of fee or fee exemptions of any kind should not be included in the advertisements or any other posting of particulars, published by the member CAs of the institute.
