Tax Consultants in Rajasthan Provokes Protest Against GST in Court

According to the sources, it is disclosed that the petition has been filed by a group of tax consultants in the Rajasthan High Court against the central and state governments alleging for unpreparedness in implementing the new indirect tax regime.

The notice has been issued by the court to the central and state governments on the request made by Rajasthan Tax Consultants Association. Penalty, not charge interest, composition window, modification of compliance requirements and retrospective effect to late fee waivers are some of the issues that tax consultants mentioned in the petition.

The government will be required to issue the notice in this matter by 13th September. Tax experts said that the court decision in this matter will influence the indirect tax cases in coming future.

Advocate Sanjay Jhanwar filed a petition, who claims that GST portal yet not ready to handle the burden of thousands of taxpayers in one time and facing a technical glitch at the time of filing returns. The GSTN portal is a website where registration of forms, the filing of returns, payment of taxes and uploading of invoices can be done by taxpayers.

Tax Consultants have expressed worrisome regarding the government deadlines for different process related to the Goods and Services Tax (GST), which came into effect from 1 July across India. MS Mani, partner at Deloitte Haskins and Sells said: “There is an urgent need for more stable timelines in the return filing framework as frequent changes in dates make it difficult for businesses. Since businesses are getting used to the new return filing processes in GST and also have to deal with other tax compliance obligations, it is necessary to frame timelines that are realistic for businesses.”
