Government of India could look at offering relaxation on various tax compliances, addressing demands from taxpayers for easing up on regulations amid the coronaVirus outbreak.
It is notable that Maharashtra and Goa State tax authorities have already granting relaxations for filing value-added tax assessments for previous years. The state tax authority of Maharashtra has instructed officials to, wherever possible, correspond with taxpayers via electronic media (email), including for documents needed for completion of the time-bound assessment.
However, Assessment value added tax (VAT) filing for Financial year 2015-16 will have to be performed on priority, by March 31st. In the case where a taxpayer wants to comply on priority, the individual can do that by phone or email. Additionally, the authorities have instructed all tax officials to “avoid any physical visits to the dealer’s place of business/ residence”, further adding in same that documents/ compliance/ or any details from dealers can be received through the electronic medium.

The state tax authority further added through a notice that, “These instructions may be followed precisely in order to prevent, control and curtail the spread and transmission of coronavirus in the state”.

The High Court of Allahabad has deferred till April 6 all recovery proceedings, demolitions, auctions, and evictions in Uttar Pradesh State, while directing state authorities to not take any coercive action against taxpayers that forces them to approach the courts, in a first such move.
Along with it, district magistrates, as well as the administrative authorities, have been instructed avoiding the physical presence of taxpayers for any work/ proceedings for two weeks.
Similarly, Recovery proceedings by the district administration, financial institutions and other administrative bodies have been also deferred for two weeks.
The Utter Pradesh government has been asked to issue notice/ circulars to the effect and report compliance in less then 48 hours.
Harpreet Singh, Partner at KPMG stated that “These orders have in a way set the precedent. It is now incumbent upon other courts and tax administrations to come up with tax policy measures which can placate the declining financial sentiments of the industry at large”.
