The Bangalore Bench of the Income Tax Appellate Tribunal (ITAT) has again granted (extended) the stay to Google India by another 6 months for collection of due tax (worth Rs 1260.58 crores).
In the first hearing also, the tribunal granted a stay of 6 months. In the stay order of the first hearing, google was instructed to pay a number of Rs 15 crore for the unpaid tax within a month counted from the date of order.
Google India obeyed the order. Later on, the stay was again granted to Google by the Honorable court on the ground of waiting for the appeals that were pending before the Honorable High Court of Karnataka in the identical issue.
In the second hearing, the assessee submitted to the court that it was not the defaulter and so prayed for granting of stay again for 6 months. The Coram that consisted of George K. and B.R. Baskaran granted the extension for a time period of 6 months or up till the date on which the appeal would be disposed of whichever is earlier.
However, Income Tax Appellate Tribunal (ITAT) ordered that the assessee shall not solicit adjournment on the forthcoming date without reasonable cause.
