On Monday, the Central Board of Excise and Customs (CBEC) informed to its field officers to take all GST disputes to the Supreme Court. Including the disputes relating to the new tax regime such as registration, applicability, charging GST above MRP.
The instruction said that the move was taken by the CBEC keeping in mind that the many of the petitions have filed in courts facing difficulties with the new tax regime or tax rates after the implementation of Goods and Services Tax (GST) Regime on 1st July. The instructions also pointed out that, grants of interim relief has been provided by the high court to the petitioner to acquire the disputed tax.
“The same needs to be challenged by way of filing a special leave petition before the Supreme Court”, CBEC informed its field officers and informing them to formulate proposals to appeal in high court orders. “as expeditiously as possible.”
The CBEC also requested to its senior field officers to take all necessary actions to ‘efficaciously defend’ all petitions relating to the new indirect tax regime in high courts. According to the provisions, the goods and services tax makes a way through the previous tax regime and demands to make strategic shift in the tax barrier while also concerning upon the tax scenario on both the final product as well as raw material of that same product.
