Taxpayer-Friendly Norms for GST Inspection

The Haryana GST Department has circulated the guidelines for re-engineering internal processes to implement taxpayer-friendly measures beneath the GST Law to enhance the experience of assessees.

The circular furnished on 19th May 2022 requires that the GST Officers would show the ID cards prior to the inspection of premises. Also, it mentioned that No officer who is entrusted any function beneath the HGST Act, 2017 would visit the premise of an assessee without proper authorization.

A conference is being conducted by the Excise and taxation department for discussing the re-engineering of internal processes to rectify the experience of the assessee along with taxpayer interaction of GST taxpayers under the administrative control of the State.

The meeting was chaired by Sh. Dushyant Chautala, Hon’ble Dy. Chief Minister, Haryana along with Sh. Anurag Rastogi, IAS, ACS (E&T) and Sh. Shekhar Vidyarthi, IAS, Excise and Taxation Commissioner along with all officers with the rank of DETC and the mentioned posted in the Department.

The circular also stated the problem of introducing the process to ensure that there would be blockage of the ITC and furnished that all the Joint Commissioner of State Tax will check the information of ITC blocked above 50 lakh and all the Deputy Commissioner of the state will see the ITC blocked ranging from 0 to 50 lakh, beneath rule 86A of HGST rules, 2017 in their corresponding district and find out the causes for it. The same actions need to prove that the conditions mentioned in the sub-rule (1) have been followed while blocking the ITC. when the blockage does not follow the law then it might be cleared immediately and action for corresponding of ITC blocked legally, also the action might be opted as per the law.

Various recommendation has been given by officers to rectify the experience of the assessee with the department. The same is for the strict provisions, if any issues intercept then the execution of the above rules might be asked to draw in the notice of the head office. The problems with the approval of the excise and the taxation commissioner Haryana, as mentioned in the circular.
