  1. The goods sold by my LLP is covered under the 5% gst rate. My doubt is that whether i can avail input credit against the payment of 5% gst liability. Whether ITC not allowed against 5% GST rate is only applicable in case of services and not goods.

  2. I have finalized cost sheet of my flat with builder in Feb 2019 with flat price minus input tax credit and then 12 percent gst on that amount .

    Now from 01 April gst reduced from 12 percent to 5 percent without input tax credit . So now it’s on original flat price 5 percent only without minus of input tax credit .

    So can builder still charge same tax 12 percent as original cost sheet .my flat was registered on 20 May 2019 .please help because my understanding was customer will get benifit from gst reduction.

    Regarding GST Export, Getting error code SB001 in icegate.

    How ever i have tallyed all details on gstr1 and shipping bill both matches.
    any advise how to deal with this

    I have filled GSTR 1 of last year (2020-2021) of all month. For the month of December(2020) there’s mistake in Sale bill amount, How can I update this. I do not see edit option in any month of 2020-2021.Please advise.

  5. We are registered under GST as business entity. Have entered into an agreement with an IIM for giving short term management course for some of our clients . We collect course fee from the client firms including GST so as to pay IIM. We have raised invoice to cllients. We can collect the fee and gst from client and make the payment and gst directly to IIM. Or we have to make the gst collected and deposited to govt through challan. Please clarify

    Principal Place of Business -Contact Information -Others (Please specify)

    I have already submitted consent letter from owner of premises and his Property Tax Receipt, besides other documents.

    What else do you think they require ? Aadhaar Card of owner/Telephone Bill ?

  8. Credit Note Entry Problem In GSTR3B at GST site

    I am getting an error when uploading the gstr3b JSON file. It is caused by -(negative) amount its occur due to I received Credit Note and I issued a purchase Debit Note

    The JSON which you are uploading is not valid. Kindly download the latest offline utility from the portal and enter the data. Click on the validate button, generate JSON, and try uploading it. Kindly do not modify JSON manually after generating it from the offline tool. If the error persists quote error number RT-SCVU101 when you contact customer care for a quick resolution.

  9. GST on sale of assets of an exempted Business.

    The Business doesn’t have registration as the same is under an exempted category like Medical services.
    The entity wants to sell all assets and clear all liabilities as the business is no more feasible.
    The act says “GST to be collected and paid on the sale of Capital goods.
    The act further says “registration must be obtained for doing business of Supply goods and/or services”.

    Now the point is

    1. How can the business deposit the tax collect without registration under GST?

    2. How can the business get a registration, to deposit the Tax collected, when there would be no further business proceeds?

    3. Can a registration be obtained for the deposition of tax and terminated immediately after?

    1. Since your company is unregistered there no question of GST, however, you should calculate the capital gain if any and show the same in your respective return, If still, you are not satisfied with the answer please contact to GST practitioner

  10. I got my GSTIN cancellation order at 02.08.2018. But I didn’t file GSTR 10 OR FINAL RETURN in due time due to ignorance. Recently I got a mail from Ronodev Basu@ range5bpd.gst @ gov.in on 7th Feb 2019 to file GSTR 3B from August 2018 till date. I have my GSTR cancellation order with w.e.f 20.09.2017. I noticed that the late fees of final return standing at 8800/-. What should be the best to do now?
