Tax Authority Issues GST Demand Notices to Airtel and SBI Life

The Goods and Service Tax Appellate Authority asked Bharti Airtel to pay INR 194 crore GST on license fees and spectrum usage charges asked by the Department of Telecom, a regulatory filing said.

The case is related to the demand for tax of INR 604.66 crore by the GST department under the RCM (reverse charge mechanism) on license fees (LF) and spectrum usage charges (SUC) basis the demand note issued via the Department of Telecommunications.

A plea has been filed by the company against the order.

“On an appeal filed by the Company to Commissioner (Appeals), Central Goods and Service Tax Appellate Authority, Delhi, the Appellate Authority has passed an appeal order reducing the said demand to Rs 194 crore,” the company stated.

On August 21, the company obtained the order and it is assessing the impact of the petition order and will opt for appropriate measures.

SBI Life mentioned that tax authorities have imposed a demand notice of nearly Rs 239.27 crore for the short payment of GST for the FY 2019-20.

The company obtained an order for the interest and penalty from the Deputy Excise & Taxation Commissioner, Rohtak, Haryana, SBI Life said in a regulatory filing.

It also cited that the demand notice related to the investment/saving portion of the premium and input credit availment.

A demand for GST has been raised by the authority along with the applicable interest and penalty for FY 2019-20.
