Cos Now Moving Towards Appellate Authority After Receiving GST Demand Notices

Various large companies that obtained the GST demand notices intend to file a petition with the appellate authority.

A rise in the number of GST notices has been sent before distinct companies, particularly on account of the alleged differences in the ITC.

ICICI Lombard General Insurance Company Limited, received an order from the Additional Commissioner, Customs & Central Tax, Hyderabad GST Commissionerate, asking for a GST demand of Rs 14,786,059 and charging a penalty of Rs 1,478,606.

“The company would pursue an appeal with the Appellate Authorities and evaluate other legal options against the order,” ICICI Lombard cited.

The order has levied the demand on the foundations of calculation of GST ITC eligible for the company and alleged unreleased tax obligations as of differences between the returns filed via the company.

Under the Central Goods and Services Tax Act, 2017, Vodafone Idea expressed it received an order confirming a penalty of Rs 14,82,096 including a tax demand and interest as subjected to be applied. For the alleged availment and utilization of excess ITC for FY 2018-19, the order has been issued.

“The company does not agree with the order and will take appropriate action for rectification or reversal of the same,” Vodafone Idea stated.

For a demand of Rs 95,68,375, Bombay Dyeing received an order from the Excise and Taxation Officer, Gurugram.

For a mismatch in ITC claimed the order was issued as per the books and as per the GST portal, short payment of tax in GSTR-3B, and short payment of tax under RCM as corresponded to GSTR2A and GSTR-3B, Bombay Dyeing stated.

Bombay Dyeing cited that we shall file a petition to Appellate Authority as the ITC claimed as per the books are following the law. On the financial procedures of the company, no material impact is there.

A GST order from the Deputy Commissioner of State Tax, Dehradun, in the case of erstwhile Exide Life Insurance Company Limited on April 10 is been obtained by HDFC Life Insurance. HDFC Life stated that the same order shall not have any adverse material impact on the financial procedures of the company and the company challenged it through the way of the petition before the Appellate authority.

Rallis India, a Tata enterprise, quoted that it obtained 4 orders from the Joint Commissioner of Sales Tax (Appeals), Nagpur division, dismissing the petitions furnished before it for the category of business activities, and dues aggregating to Rs 5.01 crore, including GST penalty and interest, under the Bombay Sales Tax Act and Central Sales Tax Act for the financial years 1999-2000 and 2000-2001.

Rallis India elaborated that on the foundation of the values of the case, prevailing law, and the direction of the counsel, the company is preparing to appeal against these orders before the Appellant Authority expecting favourable orders from the authorities.
