Under the Ministry of Corporate Affairs Registrar of Companies (ROC), Chandigarh has levied a penalty of Rs 50,000 on an individual for breach of provisions related to Director Identification Numbers (DIN) under the Companies Act, 2013.
From the order dated March 23, 2026, the default has emerged because of the allotment of two DINs to the same individual during LLP incorporation, which is restricted u/s 155 of the Act. The individual considered that the duplication had taken place because of ignorance and inadvertence, without any mala fide intent, and filed a suo moto application for adjudication.
The adjudicating officer upheld that keeping multiple DINs constitutes a breach and charged the maximum penalty of Rs 50,000, with no additional pre-day penalty, as the default was not continuing.
Further, the order directs:
- The penalty needs to be paid within 90 days via the MCA e-adjudication portal
- The amount should be paid from personal sources
- An appeal can be filed before the Regional Director, Chandigarh, within 60 days
The same ruling supports stringent compliance conditions for the unique DIN allocation even in matters that consist of unintentional errors.
