Bhilwara Bar Moves Rajasthan Court Over Income Tax Audit Timeline

The Bhilwara Tax Bar has filed a case in the Rajasthan High Court, invoking Article 226 of the Constitution.

The petition requests an extension to the September 30 deadline for submitting Tax Audit Reports (TAR) for the assessment year 2025-26. This move highlights the association’s efforts to seek more time for compliance with tax regulations.

In the petition, it specified the norms of natural justice, equity, and fair play, claiming that the taxpayers, along with the professionals, are encountering issues with income tax portal errors.

Late ITR forms release and limited working days with the upcoming festive season. Due to rainfall and floods, various regions in India have been damaged, which is affecting the compliance efforts mentioned in the petition.

Apart from the Bhilwara Tax Bar Association, various other tax bodies, including chambers of commerce and the Institute of Chartered Accountants of India (ICAI), are urging the Finance Ministry to provide a specific time.

On September 19, the ICAI requested a two-month extension. They cited the need for time between non-audit ITR filing and TAR submission.

Campaigning for the same extension, tax professionals have taken to the social media platform X. To date, the income tax department has not responded, but relaxation of the last date has been provided in similar cases earlier.

  1. I definitely agree that date needs to be extended. PORTAL PROBLEMS, HEAVY RAINS. FLOODS HAVE contributed which are natural disasters and no body can control them. It will be grave injustice TO THE TAX PROFESSIONAL COMMUNITY as a whole if date is not extended.
