The Delhi High Court on Tuesday 5th May asked the IT department to go through the applications of the pensioners whose pension account has been attached by the Department. The petition was filed by Lalita Aggarwal for amendment in the attachment of the Petitioner’s bank account, to provide a permit for the cash withdrawal (Pension) from their SBI and HDFC accounts and also for withdrawal of a blanket attachment order under which the accounts have been attached.

The petitioner stated that the pension amount that is being deposited in the bank accounts are attached even when the pensions are exempt according to Section 11 of Pension Act, 1871. In this matter, Justice Sanjeev Sachdeva passed an order and asked the Income-tax department to pay attention to the application filed by the debtor/pensioners whose pension account has been attached by the IT Department. Justice Sanjeev Sachdeva stated that “On petitioner filing a representation, the competent authority shall consider the same and dispose of it, in accordance with the law, bypassing a speaking order, preferably, within a period of one week,”.
