Illegal GST for RTI Queries

In a recent crackdown over illegal GST collection, this time the government itself found to be collecting goods and services tax on RTI which is totally out of the ambit of the new indirect tax regime.

The RTI department of Madhya Pradesh recently collected GST with an activist who was sorting out for a detailed expenditure on the renovation of RERA building.

The activist was asking for the details under the RTI act 2005 which is completely free from being taxed under GST. However, the RERA replied that there is no information available regarding such expenses and applied the GST on the query.

The housing board said the answer along with the CGST and SGST of 9 percent each amounting to 43 rs and 2 rs per document totaling to 36 on which CGST and SGST were accrued at 3.5 each.

The activist complained about this fact to the housing board chief and the chief in return sent a notice to the executive engineer regarding the unethical GST collection.

The said activist is set to lodge a complaint in the state information authority mentioning that the state government is collecting illegal tax collection while stating that the RERA refused to give information.

The union finance ministry has earlier exempted the RTI Act 2005 from the ambit of GST and the major issues here stocks that even after GST free RTI query the collection was made on the basis of CGST and SGST.
