The government wants some assessees to pay the taxes even before they have some income and ascertain the TDS (Tax Deducted at Source) on it to pay. Such assessee includes those taxpayers who have to pay self-assessment tax amounting more than Rs. 1 lakh for the financial year 2019-20 and if any assessee fails to comply to do so, a penalty of 1% per month will be charged as per section 234A of the Income-tax Act.
The last date to file returns and issue the TDS certificates for banks and other deductors like employers is 31st July 2020 and 15th August 2020, respectively. Because of the coronavirus outbreak, these deadlines were previously set on 31st May 2020 and 15th June 2020 respectively and then shifted. In most of the cases in which the TDS is deducted, the deductor and the deductee already has the information about the TDS amounts and the same gets reflected in Form 26A as soon as the deductor issues the TDS certificates. Now, the last date to issue the TDS certificates
“The result of the above situation is that individuals whose income suffers TDS to a large extent will face problems in calculating their total income and the tax already deducted on it. Consequently, they will be unable to calculate the self-assessment tax payable on their total income accurately by July 31. Therefore, paying the correct amount in full by July 31 becomes very difficult. Alternatively, they may end up paying more to avoid penal interest and have to claim a refund,”
So the government wants these assessees to file the returns even before ascertaining their income. Previously, the assessees did not face any problems in filing the returns as the last date to file the returns and issuing TDS certificates were 31st May and 15th June respectively, which are ahead of the other normal deadlines like that of income tax returns and self-assessment tax, 31st July, giving the assessees enough time to calculate the returns according to form 26AS
The last date to file the income tax returns for the financial year 2019-20 is 30th November 2020 but the last date to file self-assessment tax for the assessees with a tax liability of more than Rs. 1 lakhs is 31st July 2020, creating some problems for the assessees.
“It seems that this aspect has been missed out by the government as a result of which the present anomaly has arisen. Till the time the government does not amend the notification, the taxpayers will have to estimate their liability and pay tax if they want to avoid payment of interest u/s 234A”, says Sachin Vasudeva, a Delhi-based practicing chartered accountant.
