The government has been trying to impose the Goods and service tax in the said timeline of July 1, but the opposition has been creating all sorts of extension and to take the GST bills towards completion and worthwhile to take the support from their network, and wants to take some modifications from the Central goods and service tax. The opposition has been also wanting Parliament to take some lead in front of GST council in the issues regarding goods and service tax.
The opposition parties like Trinamool Congress, the Samajwadi Party and the Congress with their senior party leaders were in constant action to apply the changes in the GST legislation as when they are taken into the hands of Upper house. The GST council has also taken the power from Parliament as the legislation approved by the Lok Sabha previously, and the parliament will only declare the GST rates which will outcome from the GST council at the base.
A senior opposition leader was very much disgruntled with the power being possessed by the GST council over the parliament and asked that, “How can GST Council be superior to Parliament?” and questions the statement in which it said, “the government shall notify indirect taxation rates” as passed by the Parliament on recommendations of GST Council”. This modification in the phrase will, however, the parliament tin the supremacy and will ensure that the GST council supervises the indirect tax regime consciously.
The attempt was just to take advantages of the number game of opposition and to take the notice towards the supremacy of parliament which it holds in front of GST council. The complex game can still be further stretched as the upper house has limited powers and the lower house can reject the bills altogether. And an extra burden will again resurrect as the legislation process as any modification by the Rajya sabha must be presented in the Lok Sabha for its screening where the power holding can disagree with Upper House decisions.
