Madras HC Stops Govt Order of Appointment Technical Staff to GSTAT

The central government has elected technical people to the Goods and Services Tax Appellate Tribunals (GSTAT) till additional orders.

Revenue Bar Association (RBA) has filed an appeal which challenges the laws about the appointment along with guidelines regulating the president and peoples of GSTAT that shows the GSTAT (Appointment and Conditions of Service of President and Members) Rules, 2019.

The related case has been postponed due to the GST council meeting Get to know about GST (Goods and Services Tax) council 1st to 40th meeting updates and decisions taken by members. We have covered 1st meeting to last meeting decisions still not reaching any consensus regarding the qualifications, tenure, and selection procedure, as well as other conditions relating to the constitution of the GSTAT.

The matter has been delayed for two months as the centre has attempted to repeat for more time. The advocate Rahul Unnikrishnan has appeared in Revenue Bar Association re-asserted that information denoting challenges in the case cannot withstand the scrutiny of law in the prospect of the Supreme Court’s verdict in Union of India v. R. Gandhi.

The chief justice, A.P. Sahi has finally put the matter on hold due to continuous postponement and stated that the 3 October 2019 order will be carried further till the finalization of this case and the case has been postponed to next October 28.
