ICAI Blames Clients for Delay ITR Filing, Not Favouring Extension

It is your problem if you forgot to file your tax within the due date i.e July 31, also CA would not be liable for that, pay attention to it along with the Form 16 bills and various other documents.

Choosing a revision, these professionals who work more and are busy with the numbers and excel sheets sometimes bear for the wrong deeds of the customers and might opt for things in an easier way.

They will not trouble New Delhi for filing the ITR, nor they would make their evenings ruined. There is no issue if they obtain their fees late. There would be no fault for them if they missed the due date, blame the clients who were not able to provide the details within the stipulated time, or on the government tax portal that imposes bothersome wonders.

ICAI mentioned to its members that it was “not in favour of making any representation for extension of any due date.”

The same step specified that the institute wants to be counterproductive towards the professional interest “With extended due date, efforts and expenses increase, fees do not increase. As a consequence, contribution reduces,” said ICAI’s direct tax committee in a note to members, many of whom struggle to upload documents on the portal. “Time for continuing education and knowledge updating and even for leisure is reduced, causing long-term adverse consequences. CA’s is not required to pay (the) cost of delay and taxpayers, who are subjected to costs, their association may represent (sic).”

ICAI articulated that they had incurred repeated representations for faster sorting of any bugs in the portal hence filing would become less hard.

Technical Problems

There is a shared thread on the Whatsapp chat. “Is anyone facing issues with login TRACES?… Yes, yesterday I haven’t been able to log in or file returns…Even though I experienced that once after login sometimes logout is not possible even after trying several times. DSC not getting validated. It’s slow, etc…”

TRACES or TDS reconciliation Analysis and Correction Enabling System comprises of online utility furnished by the income tax department, DCS mentioned for the digital signature certificate.

Accounting professionals cleared that tax officials would sometimes secure with a tough time in data uploading on the portal. There is more than 3.3 lakh CAs out of which little less than half of them were immersed in full-time practice.

Hence CAs were advised by the committee to “enlighten taxpayers to provide data on time to avoid unpleasant consequences.”

Once again the committee has shown the glitches in the portal to the Central Board of Direct Taxes (CBDT), under the Finance ministry the apex head. CBDT is then obligated for deciding if there is a reason for forcing back the due dates.

The email from the committee specified that “…Please discharge assignments diligently, take due representation from assessee for income computation and mandate to upload ITR. Please do not carry any pressure, work with pleasure (sic),”

The tax expert mentioned that “The tone is very different… I have never received such a note from the institute. It’s good… In fact, I also am happy that it has not been written to the government for a deadline extension,”.
