There are several complaints of the urgent recovery through the GST officials in the search operations, Gujarat high court directed the central and state council for a stay as temporary in collecting or taking any due or amount from the businessman till search operation goes on. It is to be implemented if they are imposed and pressurized to pay the dues.
The two judges J B Pardiwala and Justice I J Vora directed that the Central Board of Indirect Taxes
The court has clarified that even if the taxpayer is forced to furnish the dues the officials should not accept the amount. Rather than that the taxpayer must be urged to come to a day post the search gets finished.
The High court was for the stringent disciplinary action with respect to the GST council who has been seeming to recover the GST in the search operations. Meanwhile, the judges provided that the guidelines post discussion with the advocates serving governments and numerous industrialists who have been accused of urgent recovery. The High court has been criticizing the revenue council for this urgent recovery post shocking incident of Kanubhai Patel the owner of Bharat Acid and Chemicals in Vapi, who has been delayed for 33 hours came under the light. Prior to permitting to go, he was made to furnish Rs 9 cr. Post this case the other companies such as Bhumi Associates, Apurva Chemicals Pvt Ltd, Hemani Intermediates Pvt Ltd, including Ideal Dye Chem Industries indeed approached the High court and complained about imposing the dues that are being urged by the GST dept during the search proceedings.
