Wife Can Raise RTI Request to Know Husband’s Income: CIC

Through Right to Information (RTI) wife have the right to ask the salary of their husband along with the related information said The Central Information Commission (CIC) on Wednesday.

CIC has given the major declaration post-hearing the appeal furnished by Rahmat Bano of Jodhpur post IT department ruled that the income of her husbands belongs to the third party.

CIC after listening to the other cases specifies that the wives of the government servants have the right to know the income of their husbands as per the norms of the RTI act.

During hearing the matter CIC denied the query of her who had a complaint asking about the husband’s salary and asked the income tax department of Jodhpur seeking information about her husband’s gross and taxable income, within 15 days from the date of the order.

The CIC moreover refused the argument that the details concerning the 3rd party don’t entitle beneath the RTI act.

Depending on the Bombay High court declaration the commission clarified for the case of Rajesh Ramachandra Kidile vs. Maharashtra SIC and Ors seeks that in the litigation in which the problem is of caring off the wife. The income information will now not seeks as confined to the category for both husband and wife that is present for the husband and is then accessible to the wife.

Pertaining to the Information Commissioner, Neeraj Kumar Gupta held that the respondent to inform the petitioner about the taxable income/gross income of her husband which is present with the public authority for the period 2017-2018, in 15 working days from the order of receipt.
