August 31 Declared as Deadline to Clear Pending Income Tax Returns

CBDT has recently made a declaration that August 31 is the last date to settle down the income tax returns for all the taxpayers. These pending ITRs belong to 6 assessment years from 2009-10 to 2014-15, which are due for processing and issue of refunds because of the non-filing of ITR-V acknowledgement form at its collection centre based in Bengaluru.

The department has stated that it is offering the “final opportunity” to the defaulters to immediately authenticate their income tax returns through the electronic verification by Aadhaar or through the bank account based facility, which is available on the official web portal. The taxpayers can even send a bonafide copy of the ITR-V to the Bengaluru based CPC via “speed post” before 31st August.

“…in case of returns for AYs (2009-10 to 2014-15) which were uploaded electronically by the taxpayer within the time allowed under section 139 of the Act and which have remained incomplete due to non-submission of ITR-V Form for verification, hereby permits verification of such returns also through EVC.”

A CBDT directive told PTI, “Such verification process must be completed by August 31. As an alternative to EVC, the taxpayer is allowed to send a duly-signed copy of ITR-V to the Central Processing Centre, Bengaluru by this date by speed post.”

The department also added that in situations “where the taxpayer concerned had submitted the ITR-V Form after the permitted time which earlier being treated as non-est (does not exist) and evidence of same is available with the department, the same shall be treated as valid compliance of this order and dealt with accordingly.”

Further, CBDT informed that the breather will not be applicable to cases “where during the intervening period, the department has already taken recourse to any other measure as specified in the Act for ensuring filing of tax return by the taxpayer concerned after declaring the return non-est.”

The department also clarified that “the final opportunity being provided to the taxpayers to regularise their pending ITRs pertaining to AY 2009-10 till 2014-15 which were filed as per provisions of section 139 of the Act but were declared non-est/have remained pending for verification just for want of receipt of a valid ITR-V form at CPC, Bengaluru.”

The concerned taxpayers can check the status of their pending returns for the above mentioned assessment years at the IT department website at the given link:

They can log in with the help of their PAN number and choose the specific year of assessment. Moreover, in order to make the system paperless, the department had introduced e-validation of ITRs with the help of Aadhaar and bank account numbers.

A senior official of CBDT had issued latest order when the department received several complaints from the taxpayers whose refunds were pending or remained un-processed when their IT-V couldn’t reach the CPC. As per CBDT, all the cases received till 31st August will be processed by November and any pending interest amount will be payable to the taxpayer.
